Although our firm practices primarily in Wake County, North Carolina the forms that are being provided to you are valid throughout the entire state of North Carolina and can be used in any county within our state. Keep in mind, however, that different judges, and courts in different counties, may have their own particular procedures and ways of doing things. The county court clerk’s office can be a valuable resource to you and often tell you if they have any special forms or requirements. County court clerks cannot give legal advice, but they can tell you what their court or judges require and it would be beneficial with you to utilize their help whenever you need it.

Do I Need An Attorney?
One basic law you need to be aware of is that either you or your spouse must live in North Carolina for at least 6 months immediately before filing a complaint with the court. Without this requirement being met, your Divorce will be rejected and you will be wasting your time and money by purchasing our kit and completing the forms.
As you contemplate the filing of your Divorce, one important question you will need to answer is whether you need an attorney. The answer to this question will depend on many factors, such as how comfortable you feel handling the matter yourself, whether your situation is more complicated than usual, how much opposition you get from your spouse, and whether your spouse has an attorney. A very general rule is that you should consider hiring an attorney whenever you reach a point where you no longer feel comfortable representing yourself.
In considering whether to hire an attorney you will want to consider how much an attorney will cost. The answer to this question varies. I have seen ads where attorneys charge as little as $150 and I have heard of attorneys charging as much as $1,000 for a simple Divorce in the state of North Carolina. Our firm charges clients a $615 attorney fee and collects the $134 filing fee up front for a total of $750. From what we have learned this is an average fee that most attorneys charge.
The following are some reasons you may want to represent yourself instead of hiring a lawyer:
* You save the cost of a lawyer * Believe it or not, the procedure may be faster. Most attorneys will work hard and diligently work to obtain your Divorce as quickly as possible. Unfortunately, there are some that will not. * Selecting any attorney is not easy. You should sit down with at least 2-3 attorneys to get an idea of how they plan to represent your interests and to see who you feel comfortable with. The problem is you may end up paying more in consultation fees to get this answer and then you will end up with that “One Thousand Dollar Divorce.”
